Terms of Service

1. Ownership and Intellectual Property

The DayStalkers Research Network, including its branding, compiled datasets, analytical systems, investigative mapping tools, interfaces, clustering methods, visual outputs, and platform structure, contains proprietary material owned by Daniel Reidmiller unless otherwise stated.

The organization, selection, arrangement, compilation, and presentation of reports, coordinates, analytical outputs, and associated datasets constitute a proprietary research database and investigative analysis system protected under applicable law.

No portion of the Services may be reproduced, redistributed, scraped, copied, downloaded, mirrored, harvested, stored, transmitted, republished, or commercially reused without prior written permission.

Automated scraping, bulk extraction, dataset harvesting, automated querying, or derivative commercial use of the Services is strictly prohibited.

2. Data sources and attribution

The Services may display public-domain archival materials, government publications, environmental datasets, and user-submitted content.

Public-domain materials remain subject to their original source rights and limitations where applicable.

DayStalkers does not claim ownership of public-domain materials and does not assert affiliation with private reporting organizations unless explicitly stated.

3. User submissions

By submitting content, you represent that the submission is accurate to the best of your knowledge and that you have the right to provide the material.

Submissions must not contain knowingly false information, unlawful material, personal identifying information about others, or content intended to manipulate analytical outputs.

DayStalkers may review, moderate, classify, delay, edit, generalize, anonymize, or remove submissions at its discretion to protect dataset integrity, research quality, operational reliability, and user safety.

4. Account and access

Certain features may require account registration, subscription access, administrative approval, or paid membership.

Access may be restricted, suspended, or revoked for violations of these Terms, abuse of the Services, fraudulent activity, or misuse of analytical systems.

Paid services and subscriptions may also be subject to the Refund and Digital Services Policy available at /legal/refunds.html.

Clusters, heatmaps, corridors, probability layers, and related analytical outputs are interpretive visualizations derived from reported data, geographic grouping, environmental modeling, and analytical methods.

These outputs do not represent confirmed biological presence, scientific proof, verified movement, or predictive certainty.

All analytical outputs are probabilistic, interpretive, and informational in nature and are provided solely for research and investigative purposes.

7. Assumption of risk

The Services may reference field research, travel, outdoor activity, or geographic investigation. Any such activity is undertaken entirely at your own risk.

You are solely responsible for complying with all applicable laws, including trespass laws, wildlife regulations, land-access restrictions, and local ordinances.

DayStalkers is not liable for injury, loss, damage, or legal consequences resulting from user actions, field activity, or reliance on Service information.

8. Digital services and availability

The Services are provided as digital tools and evolving analytical systems. Features, interfaces, datasets, visualizations, and research outputs may be modified, restricted, updated, or discontinued at any time without notice.

We do not guarantee uninterrupted operation, permanent data availability, or continuous access to specific features or datasets.

Analytical models, clustering systems, and geographic outputs may evolve over time as additional data, moderation actions, or updated methodologies become available.

9. Indemnification

You agree to indemnify and hold harmless DayStalkers and its operators from claims, damages, liabilities, or expenses arising from your use of the Services, submitted content, or violation of these Terms.

10. Limitation of liability

The Services are provided “as is” without warranties of any kind.

To the maximum extent permitted by law, DayStalkers shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from use of the Services.

11. Governing law

These Terms are governed by the laws of the State of Michigan, United States.

12. Changes

We may update these Terms at any time. Continued use of the Services after updates constitutes acceptance of the revised Terms.
